Understanding Courthouse Wedding Ceremonies: What They Are and How They Work

A courthouse wedding is a civil ceremony performed by a judge, magistrate, or authorized court official. Unlike religious ceremonies held in churches or temples, courthouse weddings are legal proceedings that create an official marriage record. These ceremonies typically take place in a judge's chambers, a courtroom, or a designated wedding room within the courthouse building.

Courthouse weddings serve as a straightforward path to legal marriage. The ceremony itself is brief—usually lasting between 5 and 15 minutes. A court official conducts the service, which includes reading applicable marriage laws, having both parties declare their intent to marry, exchanging rings or vows if desired, and signing the marriage license. Some couples choose courthouse weddings for practical reasons: lower costs than traditional venues, faster scheduling, or personal preference for a simple, intimate gathering.

The legal outcome is identical to any other wedding. Once the marriage license is signed by both parties and the officiating official, the marriage becomes legal and binding. The courthouse records the marriage and issues a certified marriage certificate, which serves as proof of the marriage for all legal purposes—including name changes, insurance, taxes, and social security matters.

Each courthouse operates slightly differently depending on local rules and state laws. Some courthouses offer specific wedding days or times, while others accommodate ceremonies on regular business days. Some have designated staff who perform ceremonies regularly, while in other locations judges volunteer their time. Understanding your local courthouse procedures is essential before scheduling.

Requirements and Documentation Needed Before Your Courthouse Wedding

Before you can marry at a courthouse, you must obtain a marriage license from your county or state. This is a legal document that gives you permission to marry. The marriage license is separate from the marriage certificate—the license allows you to marry, while the certificate proves you did marry after the ceremony is complete.

Marriage license requirements vary by state and sometimes by county. Common requirements include proof of identity, proof of age, residency information, and medical records in some states. Most states require a valid government-issued photo ID like a driver's license, passport, or state ID card. You typically need to show your birth certificate or certified birth record to prove your age and identity. Some states still require blood tests or health screenings, though this is becoming less common.

Here are typical documents you may need to bring:

• Government-issued photo identification (driver's license, passport, state ID)
• Original birth certificate or certified copy
• Social Security card or number
• Proof of divorce decree or death certificate if previously married
• Proof of residency (utility bill, lease agreement, or similar document)
• Completed marriage license application form
• Payment for the license fee (typically $20-$100 depending on location)

Waiting periods also matter. Many states have mandatory waiting periods between when you apply for a marriage license and when you can use it. These periods typically range from zero to five days. Some states have longer waiting periods if you waive blood test requirements. A few states offer expedited licenses for additional fees. You need to account for this timing when planning your wedding date.

Name requirements are worth noting too. Both parties must provide their legal names as they appear on official documents. If you've had a recent legal name change, you may need documentation of that change. After the wedding, you can change your name through a separate legal process—the courthouse cannot complete a name change during the marriage ceremony itself.

Takeaway: Visit your county clerk's website or call the marriage license office at least two weeks before your planned wedding date. Request a complete list of required documents and current fees. This prevents delays and last-minute scrambling for paperwork.

State-by-State Variations: What You Should Know

Marriage laws differ significantly across the United States. What works in one state may not be allowed in another. Residency requirements, waiting periods, witness requirements, and age restrictions all vary. Understanding your specific state's rules prevents problems and delays.

Residency requirements are a key difference. Some states require at least one party to be a resident of that state before obtaining a marriage license. Other states have no residency requirement at all—you can get married in a state where neither party lives. A few states require residency for a specific time period, such as 15 days before applying. If you're planning a destination wedding in a different state, research whether residency matters.

Waiting periods show dramatic variation. Several states have no waiting period and allow same-day marriage ceremonies. Other states require a one-day, two-day, three-day, or five-day waiting period between license application and ceremony. A few states allow you to waive the waiting period in certain circumstances. Nevada, for example, issues licenses immediately with no waiting period. Iowa and Massachusetts also have no waiting periods. In contrast, some states enforce three or five-day waiting periods with limited exceptions. This timing significantly impacts your planning.

Witness requirements also differ. Most states require at least one or two witnesses present during the ceremony—typically people who are unrelated to the couple and of legal age. Some states specifically require witnesses to sign the marriage license along with the couple and official. A few states have eliminated witness requirements entirely, while others make witnesses optional for courthouse ceremonies but required for other settings. Some states allow courthouse employees to serve as witnesses, while others require you to bring your own.

Age requirements and parental consent rules vary too. Most states allow marriage at age 18 without restriction. However, states differ on whether younger people can marry with parental or judicial consent. Some states set the minimum age at 16 with consent, others at 17, and some don't allow marriage under 18 at all. If either party is under 18, you need to research your state's specific rules and understand what consent documentation is necessary.

Takeaway: Search your state's name plus "marriage license requirements" on your state government website. Look specifically for waiting periods, witness rules, residency requirements, and age restrictions that apply to you.

Finding Your Local Courthouse and Scheduling Your Ceremony

Locating the correct courthouse and understanding its procedures is your next step. Most counties have one courthouse that handles marriage licenses and performs ceremonies, though larger counties may have multiple locations. Calling ahead is essential because courthouse procedures and availability vary widely.

To find your courthouse, search online for "[your county name] clerk's office" or "[your county name] courthouse." Most counties now have websites with phone numbers and hours of operation. The clerk's office, family court division, or marriage license bureau can answer questions about scheduling and requirements. Having the courthouse's phone number lets you verify current procedures directly rather than relying on outdated websites.

When you call, ask these specific questions:

• What days and times do you perform marriage ceremonies?
• How far in advance must ceremonies be scheduled?
• Can we schedule a specific date or are ceremonies first-come, first-served?
• How many guests are allowed in the ceremony room?
• Do you provide an officiant or must we bring one?
• Can we bring our own rings, vows, or music?
• What is the fee for the ceremony (separate from the license fee)?
• What happens if we need to reschedule or cancel?
• How long does the entire process take from arrival to completion?
• Where do we pay fees and what payment methods are accepted?

Some courthouses schedule marriages on specific days—often Friday afternoons or certain weekday mornings. Others perform ceremonies throughout regular business hours. A few have wedding waiting lists or require advance scheduling weeks or months ahead. Understanding your courthouse's specific schedule prevents disappointment or missed opportunities.

Document all the information you receive—names of staff members you speak with, dates availability, fee amounts, and specific instructions. This creates a reference you can return to if you have questions later. Some courthouses provide written guidelines; ask if they can email or mail this information to you.
